Welcome to Atmosphere. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). Please read carefully before using our services.
1. Acceptance of Terms
By accessing and using Atmosphere services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you may not use our services.
2. Our Services
Atmosphere provides various hosting services, including but not limited to:
- Virtual Private Servers (VPS)
- Dedicated Servers (Standard and Bulletproof)
- Bulletproof VPS with DMCA-ignored hosting
- AntiBot and DDoS protection services
Details of each service, features, and pricing are described on our website. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
3. User Accounts
3.1. Account Registration
To access certain features of our services, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process. You must be at least 18 years old or have parental/guardian consent to use our services.
3.2. Account Responsibility
You are fully responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.
3.3. Two-Factor Authentication
We strongly recommend enabling two-factor authentication (2FA) for enhanced account security. You are responsible for maintaining access to your 2FA device.
4. Payment and Billing
4.1. Pricing
Prices for our services are displayed on our website and may change at any time. All prices are in USD and are exclusive of applicable taxes unless otherwise stated. We reserve the right to modify pricing with 30 days' notice for existing customers.
4.2. Payment Methods
We accept cryptocurrency payments only through our payment processor OxaPay. All payments are processed securely, and we do not store your payment information. Cryptocurrency transactions are final and non-reversible.
4.3. Billing Cycle
Services are billed on a prepaid basis according to the billing cycle you selected (monthly, quarterly, annually). You are responsible for ensuring timely payment to prevent service interruption. We do not provide automatic reminders for payment due dates.
4.4. Refund Policy
Due to the nature of cryptocurrency payments and the instant provisioning of our services, all sales are final. We do not offer refunds except where required by law or in cases of service unavailability caused by our infrastructure (excluding force majeure). Refund requests must be submitted within 7 days of service activation.
4.5. Service Suspension
Failure to pay invoices within the specified timeframe may result in service suspension or termination. Suspended services may be permanently deleted after 7 days without payment.
5. Acceptable Use Policy
5.1. Prohibited Activities
You agree not to use our services for any illegal or prohibited purposes. Prohibited activities include, but are not limited to:
- Child exploitation or abuse content (CSAM) - Zero tolerance policy
- Distribution of malware, viruses, or ransomware
- Phishing, fraud, or identity theft
- Sending spam or unsolicited bulk email (except where explicitly allowed for bulletproof services)
- Port scanning or network attacks against third parties
- Cryptocurrency mining (except on dedicated servers with prior approval)
- TOR exit nodes (contact support for approval)
- Terrorist content or activities
5.2. DMCA and Copyright
While some of our services are located in DMCA-ignored jurisdictions, we expect users to respect intellectual property rights. We reserve the right to investigate and take action on repeated abuse complaints.
5.3. Resource Usage
You must not abuse server resources or interfere with other users' services. This includes excessive CPU usage, network abuse, or any activity that degrades service quality for others.
6. Service Level Agreement (SLA)
6.1. Uptime Guarantee
We strive to maintain 99.9% network uptime for our services. Planned maintenance will be announced at least 24 hours in advance. SLA credits may be requested for unplanned downtime exceeding 0.1% per month.
6.2. Support Response Time
We aim to respond to support tickets within 24 hours. Emergency issues (server down, critical security) are prioritized and typically addressed within 4 hours.
7. Data and Privacy
7.1. Data Ownership
You retain full ownership of all data you store on our servers. We do not access, scan, or monitor your data except as required for technical support or legal compliance.
7.2. Backups
While some services include automated backups, you are solely responsible for maintaining your own backups. We are not liable for data loss under any circumstances.

8. Service Termination
8.1. Termination by You
You may terminate your service at any time by canceling through your account dashboard. No refunds will be provided for unused service time.
8.2. Termination by Us
We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including but not limited to violation of these Terms, non-payment, or illegal activity. Upon termination, all data on your server may be permanently deleted.
9. Limitation of Liability
To the extent permitted by applicable law, Atmosphere shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to use) our services
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from our services
- Any bugs, viruses, trojan horses, or the like that may be transmitted through our services
- Any errors or omissions in any content
- Loss of data or information
Our total liability to you for all claims arising from or related to these Terms or our services shall not exceed the amount you paid us in the 3 months prior to the event giving rise to liability.
10. Indemnification
You agree to indemnify, defend, and hold harmless Atmosphere, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
11. Dispute Resolution
11.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where our services are operated, without regard to its conflict of law provisions.
11.2. Arbitration
Any disputes arising from these Terms or our services shall be resolved through binding arbitration rather than in court, except where prohibited by law.
12. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of our services after changes constitute acceptance of the new Terms.
13. Miscellaneous
13.1. Entire Agreement
These Terms constitute the entire agreement between you and Atmosphere regarding our services and supersede all prior agreements.
13.2. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
13.3. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
